("ProductNow," "we," "us," or "our") provides the ProductNow website, applications, and related services (the "Service"). This Privacy Policy describes how we collect, use, and protect information when you use the Service.By accessing or using the Service, you agree to the terms of this Privacy Policy. <h3>2. CONTROLLER AND PROCESSOR ROLES</h3>(a) ProductNow acts as a data controller with respect to personal information collected directly from individuals to operate and improve the Service. (b) When ProductNow processes data on behalf of an enterprise customer, ProductNow acts as a data processor as described in the Data Processing Addendum in Appendix A. (c) ProductNow is incorporated in Delaware, United States, and headquartered in Palo Alto, California. This Policy is governed by the laws of Delaware, with privacy compliance aligned to the California Consumer Privacy Act (CCPA/CPRA). <h3>3. INFORMATION WE COLLECT</h3>We collect the following categories of information:<ol><li value="1">Account Information such as your name, email, and authentication details (for example, via Google OAuth or Auth0).</li><li value="2">Usage Information such as pages visited, clicks, timestamps, browser type, device identifiers, and IP address.</li><li value="3">Content Information that you upload, type, or transmit through the Service.</li><li value="4">System and Derived Information including logs, performance metrics, and aggregated analytics generated by system operations.</li><li value="5">Integration Information when you authorize third-party connectors such as Slack, Google Drive, Jira, or similar services.</li></ol> <h3>4. HOW WE USE INFORMATION</h3>We use the collected information to:(a) Operate, maintain, and improve the Service. (b) Manage accounts and provide technical support. (c) Monitor usage, performance, and security. (d) Conduct analytics, internal reporting, and benchmarking. (e) Develop new features, templates, and predictive functions. (f) Communicate administrative updates and service announcements. (g) Comply with applicable law and regulatory obligations.Processing is based on legitimate interests, consent, performance of a contract, and compliance with law. <h3>4A. AI TRAINING AND PRODUCT IMPROVEMENT</h3>Information you provide through the Service, including prompts, submissions, uploaded content, interactions, generated outputs, usage patterns, feedback, analytics, and related metadata, may be used to develop, train, evaluate, improve, operate, maintain, and support ProductNow's artificial intelligence systems, machine learning models, algorithms, and related technologies.ProductNow may use such information for model evaluation, quality assurance, feature development, safety improvements, benchmarking, personalization, and other product improvement purposes, subject to applicable law. <h3>5. DATA SHARING AND DISCLOSURE</h3>We may share information with:(a) Service Providers such as AWS (cloud infrastructure), Auth0 (authentication), and Vercel (analytics and hosting). (b) Affiliates or Successors in the event of a merger, acquisition, or sale of assets, subject to this Policy. (c) Legal Authorities where required to comply with applicable laws or lawful requests.We do not sell or rent personal information. However, ProductNow may use information collected through the Service, including user content and usage data, for product development, analytics, machine learning, and artificial intelligence training purposes as described in this Policy. <h3>6. DATA RETENTION</h3>We retain personal data for as long as necessary to fulfill the purposes described in this Policy, including for legal, tax, and compliance requirements. Upon verified request, ProductNow will delete or anonymize user data unless retention is legally required. <h3>7. DATA SECURITY</h3>We maintain administrative, technical, and physical safeguards designed to protect your information from unauthorized access, disclosure, or alteration. Data is encrypted in transit and at rest using industry-standard security protocols. <h3>8. YOUR RIGHTS</h3>Depending on your location, you may have rights to:(a) Request access, correction, or deletion of personal data. (b) Request portability of your data. (c) Object to or restrict certain processing.Requests can be sent to privacy@productnow.ai. <h3>9. INTERNATIONAL TRANSFERS</h3>ProductNow may transfer information to the United States and other jurisdictions where data protection laws may differ. Where required, transfers are made under Standard Contractual Clauses or equivalent legal mechanisms. <h3>10. CHILDREN’S PRIVACY</h3>Our Service is not directed to individuals under 18 years of age, and we do not knowingly collect information from children. <h3>11. CHANGES TO THIS POLICY</h3>We may update this Policy periodically. Material changes will be reflected by updating the “Effective Date” above. Continued use of the Service after any update constitutes acceptance of the revised Policy. <h3>12. ProductNow is the data processor or service provider. (b) ProductNow processes Customer Data only to provide and support the Service and to comply with law. <h3>A.3 CONFIDENTIALITY AND SECURITY</h3>(a) ProductNow will maintain safeguards consistent with industry standards. (b) Access to Customer Data is limited to authorized personnel who are bound by confidentiality. (c) ProductNow will notify Customer without undue delay of any confirmed unauthorized access to Customer Data. <h3>A.4 SUBPROCESSORS</h3>ProductNow may use subprocessors such as AWS, Auth0, and Vercel to provide infrastructure and analytics. ProductNow remains responsible for each subprocessor’s compliance with this DPA. A current list is available upon request. <h3>A.5 DATA SUBJECT REQUESTS</h3>Where feasible, ProductNow will assist Customer in responding to individual data access or deletion requests directed to Customer Data. <h3>A.6 DATA DELETION</h3>Upon termination or Customer’s written request, ProductNow will delete or return Customer Data unless retention is required by law or for legitimate internal business purposes. <h3>A.7 AUDIT RIGHTS</h3>Upon reasonable written request, ProductNow will provide a summary of its latest security audit or SOC 2 report. Onsite audits are not permitted under this short-form DPA. <h3>A.8 SERVICE DATA PROCESSING</h3>To maintain and improve system reliability, ProductNow may process Service Data consisting of aggregated logs, telemetry, and limited de-identified inputs. This information is used only for diagnostics, scaling, and product improvement and does not include identifiable Customer Data. <h3>A.9 CROSS-BORDER TRANSFERS</h3>Customer Data may be transferred to or accessed from the United States. ProductNow will implement appropriate safeguards such as Standard Contractual Clauses where applicable. <h3>A.10 GOVERNING LAW</h3>This DPA is governed by the laws of the State of Delaware, United States.
